Almost all lenders are willing to negotiate in order to avoid the expensive fees they incur when they foreclose on a borrower. Deferment or Extension  <br>
Your lender may or may not be able to offer you a Payment Deferment. Typically, 6 payments are the Maximum Number of Payments that can be deferred but this will vary depending on your Loan and your Lender and/or Servicing Agent. If you are less than 6 months Delinquent and you can NOW afford your normal monthly payments, then you should check with your Lender/Servicing Agent for the possibility of a Deferment. If a Deferment/Extension is not an option, your next consideration would be a Forbearance Agreement.<br>
<br>
Forbearance Agreement<br>
Forbearance is usually a formal, written agreement between you and the mortgage servicer to reduce or suspend monthly payments for a specific period of time. This means that for a period of time, you would either pay only a portion of your regular mortgage payment or not make any payments at all. At the end of the agreed-upon period, you would be required to resume regular monthly payments as well as pay additional funds to make up for the past due amount over a 12 or possibly 18 month period. During the time that the payments are either suspended or reduced, you would have the opportunity to resolve the financial hardship you are facing. Forbearance plans do not remove a foreclosure action but simply stop it in place until the loan is current. <br>
<br>
Loan Modification <br>
In situations where the servicer does not believe that a repayment plan or forbearance is the appropriate course of action, a loan modification may be considered. A loan modification involves changing one or more of the terms of a mortgage in order to help you bring a defaulted loan current and prevent foreclosure. This option generally is considered for homeowners whose financial problems are expected to be more long term. This is usually the most aggressive workout a lender/servicer can do.<br>
<br>

3. The principal balance of the loan<br>
Depending on your current market conditions the common modifications right now are those made to reduce the loan amount to offset the depreciation in the home value and to reduce the payment on borrowers faced with adjustable rate increases that make monthly payments unaffordable. <br>

Modifications are made when borrowers can no longer meet the financial requirements to make their monthly mortgage payments. Lenders look at loan modifications on a case-by-case basis. The burden of proof is placed on the borrower/debtor. You must show the lender that a loan modification is less costly to them then a foreclosure. <br>

Deed-in-Lieu of Foreclosure <br>
A deed-in-lieu of foreclosure is a deed instrument in which a mortgagor/borrower voluntarily conveys all interest in a real property to the mortgagee/lender to satisfy a loan that is in default and avoid foreclosure proceedings. Generally, a deed-in-lieu is considered only after all other alternatives to foreclosure have been explored. <br>
<br>
Why Lenders Accept Short Sales: <br>
<br>
A short sale is the next best thing for lenders if they cannot help borrower's stay in their homes. It could cost lenders tens of thousands of dollars to foreclose on a property depending on the situation. A short sale helps lenders limit losses and gives them immediate pay-off from the buyer. When a property is in foreclosure or has been foreclosed on the property becomes what the banks call a toxic asset and is a liability to the bank's. Most lenders are REQUIRED to have an amount of three to nine times the retail value of each property in reserves, so a short sale gives them an immediate relief and protection of their own credit score or rating and the ability to loan that money back out and start making money again. When banks have lots of nonperforming loans they also pay a premium to borrow money just like a buyer with a less than perfect credit score. They are lenders, and are not in business to buy and sell real estate. <br>

<tr><td>Future Loan with any Mortgage Company</td>
<td>On any future 1003 application, a prospective borrower will have to answer <b><i>YES</b></i> to question C in section VIII of the standard 1003 that asks ”Have you had property foreclosed upon or given title or deed in lieu thereof in the last 7 years?” this will affect future rates.</td> 	
<td>There is no similar declaration or question regarding a short sale.</td></tr>
<tr><td>Credit Score</td>	
<td>Score may be lowered anywhere from <b><i>250 to over 300 points</b></i>. Typically will affect score for over <b><i>3 years</b></i>.</td>	
<td>Only late payments on mortgage will show and after sale mortgage will be reported as paid or negotiated. This will lower the score as little as <b><i>50 points</b></i> if all other payments are being made. A short sale’s affect can be a brief as <b><i>12 to 18 months</b></i>.</td></tr>
<tr><td>Credit History</td>
<td>Foreclosure will remain as a public record on a person’s credit history for <b><i>10 years or more</b></i>.</td>
<td>Short Sale is <b><i>not reported on a credit history</b></i>. There is no specific reporting item for ‘short sale’. The loan is typically reported ‘paid in full, settled’.</td></tr>
<tr><td>Security Clearances</td>	
<td>Foreclosure is the <b><i>most challenging issue against a security clearance</b></i> outside of a conviction of a serious misdemeanor or felony. If a client has a foreclosure and is a police officer, in the military, in the CIA, Security, or any other position that requires a security clearance in almost all cases clearance will be revoked and position will be terminated.</td>	
<td>A short Sale on its own <b><i>does not challenge most security clearances</b></i>.</td></tr>
<tr><td>Current Employment</td>	
<td>Employers have the right and are actively checking the credit regularly of all employees who are in sensitive positions.  A foreclosure in many cases is ground for immediate <b><i>reassignment or termination</b></i>.</td>
<td>A short sale is not reported on a credit report and is therefore <b><i>not a challenge to employment</b></i>.</td></tr>
<tr><td>Future Employment</td>
<td>Many employers are requiring credit checks on all job applicants. A foreclosure is one of the most detrimental credit items an applicant can have and in <b><i>most cases will challenge employment</b></i>.</td>	
<td>A short sale is not reported on a credit report and is therefore <b><i>not a challenge to employment</b></i>.</td></tr>
<tr><td>Deficiency Judgment</td>
<td>In <b><i>100% of foreclosures</b></i> (except in those states where there is no deficiency) the bank has the right to pursue a deficiency judgment.</td>
<td>In some successful short sales it is impossible to convince the lender to <b><i>give up the right to pursuit a deficiency judgment</b></i> against homeowner.</td></tr>
<tr><td>Deficiency Judgment <i>(amount)</i></td>
<td>In a foreclosure the home will have to go through an REO process if it does not sell at auction. In most cases this will result in a lower sales price and longer time to sale in a declining market. This will result in a higher possible <b><i>deficiency judgment</b></i>.</td>
