Hundreds of loan modification complaints filed against Bank of America
Hundreds of complaints about Bank of America have been filed with the Florida attorney general over mortgages and stalled loan modifications. Other major lenders have few complaints.

Hundreds of struggling Florida homeowners have filed complaints with Florida Attorney General Bill McCollum in the past year about failed or stalled home mortgage loan modifications with Bank of America.

Angry borrowers, desperate to hold on to their homes, say they've made dozens of calls to their lender and spent months asking for a change in their loan terms, only to be denied or to learn that Bank of America revoked their loan modifications a few months after they reached a deal.

"I wrote letters to the governor, I called the bank every single month," said Yvonne McBride, a disabled former state worker who received a loan modification for the Sunrise home she shares with husband Herman Acosta. But the bank retracted the deal � after, she said, she'd paid more than $9,200 to cover mortgage payments through next January.

"When they said I was noncompliant [with the terms of the loan] I said, 'What?' " McBride said.

The Attorney General's Office has logged 452 complaints about Bank of America, Florida's largest mortgage lender, concerning mortgages and loan modifications. With its acquisition of Countrywide Financial last year, Bank of America had almost 82,000 mortgage loans outstanding in Florida worth $15.3 billion in 2008, according to National Mortgage News.

Next largest is JP Morgan Chase, which had almost 69,000 mortgage loans in Florida. JP Morgan Chase has 69 complaints on file at the Attorney General's Office. Wells Fargo, which acquired Wachovia, has a combined 51 complaints on file and almost 57,000 mortgage loans in Florida.

Bank of America's spokesman Rick Simon would not comment on the volume of complaints. But he said that in individual cases, some customers are not providing necessary financial information or have not been communicating with the bank.

"Bank of America has been more aggressively pushing loan modification and foreclosure assistance than anyone else," said economist Ken Thomas, an independent banking consultant from Miami. Thomas is not a consultant to Bank of America. He said the bank may have more complaints than others because it is interacting with more borrowers. "The biggest lender in South Florida was Countrywide and they are under more scrutiny and making a bigger effort than anyone else," he said.

The Attorney General's Office is responding individually to those who complain, providing borrowers with information on mortgage fraud, the state's legal settlement with Bank of America calling for foreclosure relief, and suggesting that borrowers contact federal regulators and local attorneys. The complaints are also being sent to the lender involved.

Spokeswoman Ryan Wiggins of the Attorney General's Office said the complaints are being reviewed to determine the validity of the claims.

One year ago, McCollum, who is a candidate for governor, reached a settlement with Bank of America that was supposed to provide $150 million in foreclosure relief nationwide for its borrowers.

Under the terms of the settlement, Bank of America was to launch a loan modification program that would help 52,000 Florida homeowners get new mortgage loans.

"Bank of America has stated its willingness to cooperate in our investigation," Wiggins said.

But until the complaints from borrowers have been reviewed, Wiggins said, she could not answer the question of whether Bank of America is complying with the settlement.

Bank of America told the state it has modified more than 10,000 loans in Florida through June of this year.

Millions of troubled borrowers nationwide are candidates for loan modifications.

In Washington, the Obama administration has promoted its program to entice lenders to offer loan modifications as a key tactic to turn around the troubled housing market. The Making Home Affordable program � which says payments are past due on 3.1 million loans nationwide -- pays lenders to offer modifications.

But borrowers in Florida have run into a logjam. Stories abound of loan modifications taking months or even a year to complete.

The complaints at McCollum's office also include those from borrowers like McBride who say they completed a deal, only to have a bank revoke it..

McBride provided the Sun Sentinel with copies of notarized paperwork showing the loan modification process had been completed for her home. It took place in February.

Of McBride, Bank of America spokesman Simon said in an e-mail, "The loan modification had to be declined because the borrowers did not provide necessary documentation of financial information in a timely fashion, despite three contacts with a home retention specialist over a 12-day period."

McBride said she doesn't know what the bank is talking about.

Nicholas Gonzalez-Pardo has filed complaints with the attorney general and the federal agency that regulates national banks, the Comptroller of the Currency, over a similar story, saying Bank of America accepted his payments for six months for his home in Sebastian and then told him he did not qualify for a loan modification.

"I feel like I have nowhere to turn, the deck is stacked against me," he said.

Bank of America's Smith said Gonzalez-Pardo's modification actually begins in November, but Gonzalez-Pardo disputes that. The bank spokesman also said the bank has tried to reach Gonzalez-Pardo several times to discuss the situation.

If Bank of America is found to not be in compliance with the state's settlement, Wiggins said the state could return to court and ask for penalties, fines and attorneys fees.

Barack Obama is on track to have the most spectacularly failed presidency since Woodrow Wilson.

In the modern era, we've seen several failed presidencies--led by Jimmy Carter and LBJ. Failed presidents have one strong common trait-- they are repudiated, in the vernacular, spat out. Of course, LBJ wisely took the exit ramp early, avoiding a shove into oncoming traffic by his own party. Richard Nixon indeed resigned in disgrace, yet his reputation as a statesman has been partially restored by his triumphant overture to China.

George Bush Jr didn't fail so much as he was perceived to have been too much of a patrician while being uncomfortable with his more conservative allies. Yet George Bush Sr is still perceived as a man of uncommon decency, loyal to the enduring American character of rugged self-determination, free markets, and generosity. George W will eventually be treated more kindly by historians as one whose potential was squashed by his own compromise of conservative principles, in some ways repeating the mistakes of his father, while ignoring many lessons in executive leadership he should have learned at Harvard Business School. Of course George W could never quite overcome being dogged from the outset by half of the nation convinced he was electorally illegitimate -- thus aiding the resurgence of the liberal wing of the Democratic Party.

But, Barack Obama is failing. Failing big. Failing fast. And failing everywhere: foreign policy, domestic initiatives, and most importantly, in forging connections with the American people. The incomparableDorothy Rabinowitz in the Wall Street Journal put her finger on it: He is failing because he has no understanding of the American people, and may indeed loathe them. Fred Barnes of the Weekly Standard says he is failing because he has lost control of his message, and is overexposed. Clarice Feldman of American Thinker produced a dispositive commentary showing that Obama is failing because fundamentally he is neither smart nor articulate; his intellectual dishonesty is conspicuous by its audacity and lack of shame.

But, there is something more seriously wrong: How could a new president riding in on a wave of unprecedented promise and goodwill have forfeited his tenure and become a lame duck in six months? His poll ratings are in free fall. In generic balloting, the Republicans have now seized a five point advantage. This truly is unbelievable. What's going on?

No narrative. Obama doesn't have a narrative. No, not a narrative about himself. He has a self-narrative, much of it fabricated, cleverly disguised or written by someone else. But this self-narrative is isolated and doesn't connect with us. He doesn't have an American narrative that draws upon the rest of us. All successful presidents have a narrative about the American character that intersects with their own where they display a command of history and reveal an authenticity at the core of their personality that resonates in a positive endearing way with the majority of Americans. We admire those presidents whose narratives not only touch our own, but who seem stronger, wiser, and smarter than we are. Presidents we admire are aspirational peers, even those whose politics don't align exactly with our own: Teddy Roosevelt, FDR, Harry Truman, Ike, Reagan.

But not this president. It's not so much that he's a phony, knows nothing about economics, is historically illiterate, and woefully small minded for the size of the task-- all contributory of course. It's that he's not one of us. And whatever he is, his profile is fuzzy and devoid of content, like a cardboard cutout made from delaminated corrugated paper. Moreover, he doesn't command our respect and is unable to appeal to our own common sense. His notions of right and wrong are repugnant and how things work just don't add up. They are not existential. His descriptions of the world we live in don't make sense and don't correspond with our experience.

In the meantime, while we've been struggling to take a measurement of this man, he's dissed just about every one of us--financiers, energy producers, banks, insurance executives, police officers, doctors, nurses, hospital administrators, post office workers, and anybody else who has a non-green job. Expect Obama to lament at his last press conference in 2012: "For those of you I offended, I apologize. For those of you who were not offended, you just didn't give me enough time; if only I'd had a second term, I could have offended you too."

Mercifully, the Founders at the Constitutional Convention in 1787 devised a useful remedy for such a desperate state--staggered terms for both houses of the legislature and the executive. An equally abominable Congress can get voted out next year. With a new Congress, there's always hope of legislative gridlock until we vote for president again two short years after that.

Yes, small presidents do fail, Barack Obama among them. The coyotes howl but the wagon train keeps rolling along.

"He was a good kid, he mowed lawns, he volunteered at the church"..and then he lit his friend on fire. Miami will not be like Detroit, Philadelphia, or Atlanta because we have tourism. Many of the jobs pay low wages, but it's still a job.

The previous cities I mentioned have black on black crime, and the cities write many parking tickets to make money. I could never live in Philadelphia after seeing the show, "Parking Wars." Why would any one live in such a place that makes most of their money by booting cars, towing them, and screwing over their own people like that? I would MOVE but those people are too stupid to do it.

South Beach is nothing spectacular, but it's still a DESTINATION among foreign tourists who come because of the hype. If these people get treated like shit, they won't come back.

Orlando is scaring away all their tourists by banning those who screw up for a year. Some are even arrested for doing little wrong. Attendance at Universal Orlando is down 11% from last year, while parks up north are only down 1%.

Screw people over, and they move away from the city and don't visit.

I moved 10 years ago. My money tripled in a year. There is no industry left in Miami that is not jacked by the illegals and cheap workers. I was working as an A&P mechanic and engineer tech in training with a bunch of cubans under me and responsible to sign off for everything in my group. I moved up North Carolina to a similar job and tripled my income and everyone speeeeeekkkkeeee EEEEEnnnngggwish. Wages are far better out of Miami. Even the coke is cheaper with better results.
Still have my house down there, but who wants to compete with the scrub for scrub money.

Is there any industry left in Miami? I earned my Bachelor Degree five months ago and still can't find a job. Everyone I talk too (recruiters, workers, etc.) say my best bet is to move out of Miami. I don't have the finances or capability to move!! I'm lucky to be living with a roof over my head with someone who is lucky enough to have a job here, without speaking Spanish, in the school system, and he is constantly getting screwed. Cubans keep migrating here and are getting into Americas politics, management, etc.. and therefore, a white, American born English speaking male can't do shit. People that migrate here to America should learn how to speak fucking English and learn the American culture! Most Cubans I encounter on a daily basis are ignorant and rude as hell. Our fathers of America are probably turning in their graves knowing that America is turning into Latin America. Full of rude, arrogant, uneducated fucking Cubans who love to fight and yell and scream and argue and yell and fight and argue, etc. etc..... WTF What can I do? Nothing except vent on Craigslist.. About 4:30-5:00 today on PGA Blvd close to or on the draw bridge a Red ford Ranger Pick up or Mazda with the Tailgate down tried to run me off the road and I do believe it was set up by someone who doesn't like me .. After he tried to drive me off the road he took a hand full of nuts and bolts and threw them at me hitting me in the face and also hitting my 4 year old in the process... I don't know why he did it! That's why I think it was a set-up... If anyone saw this happen today and maybe knows this white guy with really short hair or happen to get his license plate number .. It had tinted plastic over it and it looks like he always keeps his tailgate down... If you know this person and where he lives please let me know!!! I was driving a white chevy malibu with Stop Smoking signs all over it with my phone number 561-626-3622... Call me please... I want him behind bars or in front of my bat!!!

I married a girl 25 years ago and divorced her a year later because she was addicted to heroin. After 22 years I looked her up on Craigslist. I found her living in Orlando. Now after two and a half years, both of us being arrested for domestic battery and her being arrested for drunk driving I have asked her to stop drinking or leave. She told me that she likes drinking a lot and cannot stop. She will not attend AA meetings because she will be embarassed. This will be probably the 20th time this has happened. I love this girl very much and want only the best for her but I cannot live with her drinking and abuse. How can I make myself strong enough to resist calling her again? Anyone been in this situation before? I am not desaperate for company, I really do love her when she is sober.

So the question, a year since we elected him, isn't how much Obama has accomplished. The question is why we've turned so small and mean that we only see half of it � the half we happen to agree with.
